Conditions of Use:
All subscribers must abide by the following conditions of use for the Wirephoto Lightboard. Subscription to the Lightboard service indicates the Subscriber's assent to these conditions, as well as assent to any changes to these conditions that Wirephoto might make in the future:
- The Lightboard is licensed for use as a means of delivery of photographs between professional photographers (the Lightboard Subscriber) and the Subscriber's publishing clients. The Subscriber agrees to create a unique account for each client the Subscriber wishes to grant downloading privileges. Making unrestricted public downloads available by posting login information on a newsgroup, bulletin board, website, mailing list or any other means of public broadcast is prohibited.
- The Lightboard Subscriber must own the copyright to all photographs the Subscriber hosts on the Lightboard.
- No illegal content may be hosted on a Subscriber's Lightboard.
- No pornographic content may be hosted on the Lightboard. Wirephoto's management recognizes that nudity may be legitimately employed in photographs made with the intent to be published in print, without those photographs constituting pornography. If there is a question as to whether a photograph has inappropriate sexual content, the decision of Wirephoto's management will be final.
- Wirephoto has a "zero-tolerance" policy on unsolicited e-mail being sent from the Wirephoto domain. If the Lightboard management receives a complaint of unsolicited e-mail being sent from a Lightboard Subscriber's account, e-mail privileges will be disabled for that Subscriber.
- While Wirephoto respects the privacy of its Subscribers, the Lightboard management may, at its own discretion, examine the contents of a Subscriber's Lightboard if there is an unusual level of activity for that Subscriber's Lightboard, or if Wirephoto's management is alerted in any other way that a Lightboard Subscriber may be using the Lightboard software in a manner that is inconsistent with Wirephoto's usage policy.
- While Wirephoto will try to make the Lightboard service as reliable as possible, no warranty of the service is expressed or implied. 100% uptime of the Wirephoto server is neither guaranteed nor expected. No refunds or compensation will be made for intermittent failures of the software, hardware, or network services that the Wirephoto Lightboard relies upon. The Subscriber agrees that the Subscriber is not entitled to any refund or compensation for any service outages, and that if Wirephoto, at its own discretion, does decide to refund monies after an extended interruption in service, the amount of that refund will never exceed the amount the subscriber paid for service for the month during which the interruption occurred
- Wirephoto does not provide a guarantee of data integrity for files stored on the Lightboard. No refund or compensation will be made for loss or corruption of a subscriber's files stored on the Lightboard. The Lightboard is not designed to be a primary archive for files--it is the Subscriber's responsibility to maintain offsite backups of files stored on the Lightboard.
- No refund or compensation will be made to a Subscriber for damages caused by a person accessing the contents of a Subscriber's Lightboard by unauthorized means or in an unauthorized manner.
- Wirephoto may cancel a Subscriber's Lightboard service at any time for reasons of nonpayment, breach of any provision of these Conditions of Use, or for any other reason. If Wirephoto cancels a Subscriber's Lightboard subscription, the Subscriber will still be responsible for payment of all outstanding balances accrued through the effective date of cancellation.
